Terms and Conditions
Version 2.5
Version 2.5 - in force from 30 May 2026
1. Acceptance of Terms
By accessing and using this platform, the user declares to have read, understood and accepted these Terms and Conditions. If you do not agree, you should refrain from using the platform.
2. Purpose of the Platform
This platform is exclusively intended for the management of sports activities at Brazilian Power Team Odivelas, including enrolments, attendance, payments, graduations and communication between students and coaches.
3. Personal Data Processing (GDPR)
Your personal data (name, email, contact, activity history) are processed in accordance with the General Data Protection Regulation (GDPR - EU Reg. 2016/679). The data collected is used exclusively for the management of your activity at the club and is not shared with third parties without your express consent.
The user has the right of access, rectification, erasure and portability of their data, by contacting: bptodivelas@gmail.com
4. Use of Image, Photography and Video
By accepting these terms, the user expressly authorises Brazilian Power Team Odivelas to use their image, photography and video recording - captured in the context of the club's sports activities, events, training sessions and competitions - for communication, promotion and marketing purposes on the following platforms:
- Official website of Brazilian Power Team Odivelas
- Club social media (Instagram, Facebook, YouTube and others)
- Online and offline promotional materials
- Orira platform (orira.app), including demonstration materials and commercial promotion of the management software used by the club
This authorisation is granted free of charge and without time limit, and may be revoked at any time by written request to bptodivelas@gmail.com. In the case of minors, authorisation must be provided by the respective legal guardian at the time of enrolment.
5. Confidentiality of Credentials
The user is responsible for keeping their access credentials (email and password) confidential. Any misuse of the account is the responsibility of the account holder.
6. Conduct on the Platform
The user agrees to use the platform responsibly, not sharing information about other members without authorisation and respecting the privacy of all users.
7. Liability
Brazilian Power Team Odivelas is not liable for occasional technical unavailability of the platform or for information incorrectly entered by users.
8. Changes to Terms
Brazilian Power Team Odivelas reserves the right to change these Terms and Conditions at any time. Changes take effect upon publication on the platform. In the event of a significant change, users will be notified on their next access. Periodic review of these terms is recommended.
9. Uniform and Equipment
In Jiu-Jitsu (Gi) classes, the use of the official academy kimono, clean and in good condition, is mandatory. In other modalities (No Gi, Boxing, Muay Thai, Capoeira and others), appropriate sportswear for the discipline must be worn. The academy makes equipment available for purchase.
10. NFC Access Card
Each student receives a personal, non-transferable NFC card upon enrolment. In case of loss or damage, the student may request a replacement card upon payment of €5. Until the replacement is issued, the student must identify themselves to the instructor or receptionist upon entry.
11. Participation in Competitions
Participation in competitions is voluntary. Before any registration, the student (or guardian, in the case of minors) must contact the academy in advance to ensure adequate support, correct registration and the availability of a coach or instructor during the event. Responsibility for the participation of underage athletes lies with their respective guardian.
12. Payments and Monthly Fees
Monthly fees must be settled by the agreed date. Failure to pay on time may result in temporary suspension of access to training. If an enrolment is suspended due to non-payment without prior notice, reactivation requires payment of a new enrolment fee. No refund is made for partially attended months, except in exceptional circumstances assessed by the academy management.
13. Annual Accident Insurance
Brazilian Power Team Odivelas maintains an annual personal accident insurance for sports practice, under a protocol with an insurer and its broker, identified in the academy's Partners area. Enrolment is mandatory for all active athletes and its cost is charged once per year, per athlete, as a line separate from the monthly fee, renewing on each member's membership anniversary date. The annual amount in force is the one shown at sign-up and in the payment summary. The conditions, coverage, exclusions and limits derive from the insurer's policy and the partnership protocol, whose details and document are published in the academy's Partners area and may be requested at bptodivelas@gmail.com. If a member leaves mid-year, any pro-rata refund is calculated by the insurer or broker and, under the terms of the policy, returned to the club and not directly to the athlete. The academy merely intermediates enrolment and billing; the Orira platform only records and processes this charge on the academy's behalf and is neither an insurer nor a broker. For injury treatment, the academy has a protocol with Clínica Lambert (orthopaedics, traumatology and sports medicine), its reference partner clinic. As this is personal accident insurance, the athlete may be treated at the clinic of their choice; Clínica Lambert is the recommended partner, with its own terms published in the Partners area.
14. Cancellation of Enrolment and Leaving the Academy
Cancellation of any enrolment is subject to a minimum notice period of 1 (one) month. Cancellation requests must be submitted through the platform and a reason for cancellation is mandatory. After the request, the enrolment remains active during that period and the corresponding monthly fee is due. The academy management may approve early exit in duly justified cases. Whenever a practitioner returns to the academy after a period without an active enrolment, a new enrolment fee will be charged.
15. Hygiene and Safety
Training equipment must be clean at each session. Outside the tatami, particularly when moving around the academy after changing in the locker rooms, the use of flip-flops or similar footwear is strongly advised. Students with injuries or relevant health conditions must inform the instructor before training begins. Each practitioner is responsible for following the instructor's guidance and adopting safe behaviours during practice.
16. Health and Assumption of Risk
The practitioner (or their guardian, in the case of minors) declares being physically fit for sports practice and undertakes to inform the academy of any relevant injury, illness or health condition, before starting the activity and whenever one arises. Martial arts and combat sports involve physical contact, throws and intense effort, carrying inherent risks of injury. By enrolling, the practitioner acknowledges and accepts these risks and undertakes to follow the instructors' directions and the safety rules. The academy recommends undergoing an appropriate sports medical examination. This clause does not remove the cover of the insurance provided for in these terms nor the academy's liability in legally applicable cases.
17. Protection of Minors and Guardians
Enrolment of minors is carried out and authorised by their guardian, who assumes responsibility for the minor's acts, payments and participation in the academy's activities, including competitions. The guardian consents to the processing of the minor's personal data for the purpose of managing the sports activity, under section 3, as well as the image-use authorisation set out in section 4, and may revoke them at any time in writing to bptodivelas@gmail.com. The academy may request proof of legal-representative status.
18. Governing Law and Jurisdiction
These Terms and Conditions are governed by Portuguese law. Any dispute arising from their interpretation or application shall be subject to the courts of the district of Lisbon, with express waiver of any other, without prejudice to the consumer's rights under the law.
